UK - laws question

August 1st, 2012

hellloooo fabulous 365'ers .... most of u wont know or remember me now im sure but i have a question to ask and i know what a fabulous community u are here so i thought id ask u rather than trolling my way through wording im a bit too thick to undertand "uk photography laws" gah ! lol

anyhow tis is the question ....

photographing a fete day in a public indoor / outdoor building.

Right ive done a couple recently and have now been asked to do another , ideally i want to charge a small fee to do it and the organisers would be given a disc of the photos for their own use (no reprinting for sale or to hand out just for them to use to show what they did when other events come round blah blah) anyhow , as im only charging a small fee to do that i wanted to be able to sell any photos i take to the people in the photos (if u get me )to boost my earnings ......

A) can i do that ?

B) are there any restrictions on where i can display an online gallery of the photos ?

C) would i need every person who is in the photos permission to display them online for sale ?

basically it would be photos of adults and children enjoying a local fun day / fete

Ideally i would love to display them on my facebook page with my logo listing how much they are to purchase , but unsure if i need the peoples permissions to do that :S ..... if i do thatd be a nightmare ! ...... im confused as the likes of the news papers take pics of kids / adults at public events all the time and display them online to bu , many times ive found a shot of my son that i never knew was taken displayed on facebook business pages so is that ok to do ? dont wanna walk into someone kicking off at me :S

thankyou for any help u can give ! x

There are no laws in the UK to stop you from photographing adults or children in a public place. There are also no laws for UK photographers to get a model release form in order for you to sell the photo's on. You as the photographer always own copyright, unless you signed a contract to give your rights away.

When I worked for the local paper, the school who were holding the fair/event would let the parents know in advance that a photographer would be there, as a courtesy. Perhaps you could ask to put a sign up on the entrance, or carry some ID with you. Also, always a good move to stop photographing if asked by individuals at these kinds of events!!

there are as far as I am aware no requirements in law to obtain a model release form in street photography before selling, However if the photo is deemed as Libelous or defamitory or used for in conjunction with a libelous or defamitory story then the subjects have the right to take you to court, also if selling images to a stock site the company will probably ask for model release forms for all those individuals that are recognisable in the image other than that theres nothing to stop you.

@flamez nice to see you back. Missed your pics.
our camera club does pics for local fete. we all had an Id card saying we were club members. copies of the best shots are given to the organisers. We run a screen all day so anyone can see our pics.
Had one over zealous granny object to snaps of fullu dresed, anoraked toddler in pushchair. I just deleted them in front of her to keep things couteous.
Dont know whether thst is helpful.
