Was hoping someone might be able to give me a quick answer. I'm going to a festival this weekend and I've been offered to take shots for commercial use. My question is - is a model release necessary for shots I get of crowds and such?
I know it used to be the case years ago for iStockphoto for any shot containing a person but I'm not sure the same rules apply for archives.
This paragraph I feel is the most important:
Photographers who also publish images need releases to protect themselves, but there is a distinction between making an image available for sale (even via a website), which is not considered publication in a form that would require a release, and the use of the same image to promote a product or service in a way that would require a release.
You might want to look at an event release or even a site release depending where this is happening. Some places claim that if shot on their premise you don't have the right to use the shots. Something to think about.
