So, I have this whole thing planned for tonight because it's such a special time to scare children. :) I'm going to set my tripod and camera up next to my front door, put on the scariest mask I have (honestly, I have nightmares about it, so I think it's pretty scary), and when I open the door, hit the remote to take shots of children scared sh*tless.
I might want to use these photos for something, but my question is....is it ok to post these pictures anywhere without their parents permission? I think if they are coming to my door, I should be able to take photos of them. But....I know there are some rules. But I'm not printing out model contracts for a funny (demented) halloween idea. The look of horror on little faces is priceless!

Any advice on the rules for posting these shots?

In today's litigious society, you may be setting yourself up for a "privacy issue." Generally, one gets permission to take pictures, and then the grantor may request no posting on the web etc.

i'm all about catching those little shits scared or crying... i says, go for it!!

but yeah, you may want to look into what Joe said prior to posting.

if you do post, i can hardly wait to see 'em! i may have to start following you simply for bringing up this awesome topic

It would be funny, but I could see a lot of parents quite upset knowing you used their children for that purpose. Not that they would know... unless they are on this site... but still...

The general rule is this: you can take photos, print them, sale them, knit them into a collage to hang on your garage door if you want...so long as the person does not have "a reasonable expectation of privacy."

Well...they are outside, on *your* doorstep.

I say scare the little shits, grab some good photos, and give us a few hours of endless entertainment.

you are in your rights legally if you want to do it and i can see the fun in it, but as a parent i wouldn't appreciate it at all.

Put a "Smile for the cameras" sign near your front door, and you've got everything covered. ;) Awesome.

Go for it If they have masks on how do you know whos behind the mask. Scare the chit out of em and get some good pics to share.

@canon4life I am too kind to scar a child, but not kind enough to not scare one. I think it's what the holiday is about and being a photographer, what better way to capture this years fun? I'll put the sign up like Jinx suggested, that way maybe the parents will think twice before knocking.
@jinximages I'm making the house look extra inviting and very festive! Thanks for the sign idea, I'll make sure to do that so people have a bit of a warning. ;)
@1invisiblegrl You don't want to come over!? If you change your mind, I won't wear the mask. I couldn't scare a 365er. :) And good advice about looking through the peephole. I'll do that. I don't want to scare babies. The thing to remember is it's all in good fun.

@lacedxxoo Yeah, I think that would be pretty good! I think a fisheye would look wicked (pun totally intended) so go as wide as you can!

I know if Hobbit came to your door and all that happened, I would be super upset with you. One for scaring the daylights out of my child and two, for taking her photo without my consent.

We live in a world full of weirdos and creeps - I wouldn't risk it.

@lacedxxoo I think you might have some parents upset with you and you could be getting into some trouble by doing that even if you are just taking them for fun

Even though they are on your property and they're not in a public space and I don't think you'd get very far in court making money off kids without their parents consent.

At the very least, if you do want to use them for non commercial purposes get their parents permission after you've scared them, given them candy and spoken with their parents about it.
Most people consider child photography a special case. What you're suggesting doesn't sound all that much more different from some guy walking down to the park and taking photos of little kids that aren't his own then posting it to "special interest" groups on the web.

Please don't do the very little ones. They will have nightmares forever lol. I tried to scare some kids one time and a 12 yr. old wet his pants. I felt so bad TEE HEE

I put a sign up, I heard the parents reading it to the kids (and warning them that something scary might happen), and once I knew the parents had given their ok, I opened the door and scared the poo right out of them. :) Most of the parents laughed, but even more so, they had horrifying masks on themselves and I almost peed my pants! All went well and everything is fine. I can appreciate your concerns. :)

@jasonbarnette Didn't get to use the wide angle, and I repeatedly tugged on my remote cable, causing slight shake. These were the best (sadly) of the night. I thought about tweaking some of the shots, but the idea was about fun and scaring some kids, so I'll settle for these shots. Next year I plan on doing this again, with more of a set up so I can try a little harder to capture the feeling. Quick planning sucks! :)

Ha ha ha ha there's little Mario! I figure if they touch your doorbell, then they're on your property! Take all the damn photos you want! Its freaking halloweeeeeen for christ sake!

Next year...try setting up a remote strobe. Set your camera to pre-flash (or Red Eye) mode so it'll pulse once then flash. That will probably scare the kids as much as anything.

You did a pretty good job with these. Especially spur of the moment!
