Does this qualify as a moped?

I saw this vehicle parked next to my building - it looks like a covered moped. I guess it might be useful in places where it rains a lot (although you would also get wet from the open sides), but here it rarely rains...

When I saw the sign on the side of the scooter, I knew it was a BMW.
In the heavy traffic in Toronto, Canada, I wouldn't feel safe driving it.

@bruni I think that the cover may give a false sense of safety, and the driver might be less careful than in a regular scooter...
