Fair use of photographs (Latest Appeals court ruling)

The appeals court ruled in favor of the artist who appropriated Patrick Cariou's photos. Photos he took spending years living among Rastafarians. This seems very unfair to me. I wonder what the rest of you think?

Did they define "fair use?" I agree this seems based on subjective criteria.

Reading through it, it seems to be a fairly reasonable decision to me.
